2A:42-135 Dismissal of receiver’s application to sell property.
22. a. Upon application by the receiver to sell the property the owner or any party in interest may seek to have the receiver’s application to sell the property dismissed and the owner’s rights reinstated upon a showing that the owner meets all of the conditions set forth in section 25 of Phamplet Law 2003, Chapter 295 (C. 2A:42-138) and such other conditions that the court may establish. In setting the conditions for reinstatement, the court shall invite recommendations from the receiver.
b. In connection with the sale, the court may authorize the receiver to sell the building free and clear of liens, claims and encumbrances in which event, all such liens, claims and encumbrances, including tax and other municipal liens, shall be transferred to the proceeds of sale with the same priority as existed prior to resale in accordance with section 23 of Phamplet Law 2003, Chapter 295 (C. 2A:42-136).
