Do you need a Mitchell-Lama Lawyer in New York City? What exactly is a NYC Mitchell-Lama Lawyer?
This may sound like the start to a Dr. Seuss book or another in the LLama LLama Mad at Mama series of children’s books, but the Mitchell-Lama Housing program was created in 1955 to provide affordable housing. The program was designed to assist in the development and building of affordable housing for both rental and co-operatively owned properties aimed at middle-income residents. The rules regarding this program have changed over the years. Currently, the developments are city supervised and state-supervised. The state government agency, formerly the New York State Division of Housing and Community Renewal (DHCR), was merged with the NYS Housing Finance Administration in 2010 to create the New York State Homes and Community Renewal agency that supervises the building’s financing and function as long as it is in the Mitchell-Lama program.
When selecting a lawyer you need to find an attorney that understands the rules of this program, and how your unique situation impacts your family’s eligibility. Do not hire an attorney until they have had a chance to review your situation to determine if you are eligible to remain in your home, or if you would be able to continue to afford to live in your home. Many events can affect your eligibility and the amount of rent or maintenance you are expected to pay. Also, who is listed on the affidavit of occupancy can also affect succession rights if the primary occupant of the home dies.
