Using Partition Actions To Resolve Your Real Estate Dispute

One common resolution strategy used in real estate disputes is partition actions. These types of actions are specific to real estate actions involving joint ownership of real property. Ownership in common can take on a variety of forms, including, but not limited to: property acquired during a marital union (post-marital dissolution); real property co-owned as a business or investment; or property inherited jointly from the death of a parent. Generally, whenever there is a breakdown in any one of these relationships, the ultimate result will usually require legal action in order to divide the jointly held property.

This legal action will come by way of what is referred to as a partition action, which can be used to (1) divide the real estate and/or the value of the property among those who own the property in common through what is known as equitable division; and/or (2) to effectuate the sale of the real estate and distribute the proceeds of the sale.
