2A:42-126 Bond, surety, insurance posted by receiver, removal of receiver.
13. Upon appointment, the receiver shall post a bond or other such surety or insurance in accordance with the plan approved by the court pursuant to section 12 of Phamplet Law 2003, Chapter 295 (C. 2A:42-125).
The receiver shall take possession of the building and any other property subject to the receivership order immediately after posting the required bond, surety or insurance and, subject to the approval of the court of the bond, surety and insurance, shall immediately be authorized to exercise all powers delegated by Phamplet Law 2003, Chapter 295 (C. 2A:42-114 et al.), except that the receiver shall not undertake major non-emergent improvements to the property prior to approval of the receiver’s plan by the court.
Any receiver may be removed by the court at any time upon the request of the receiver or upon a showing by a party in interest that the receiver is not carrying out its responsibilities under Phamplet Law 2003, Chapter 295 (C. 2A:42-114 et al.). The court may hold a hearing prior to removal of a receiver under this section.
